| 理由 |
1 本願商標 本願商標は,「Z-SYSTEM」の文字を表してなり,第28類に属する願書記載のとおりの商品を指定商品として,平成27年9月8日に登録出願されたものであり,その後,原審における同28年3月9日付けの手続補正書及び当審における同30年6月6日付けの手続補正書により,その指定商品は,第28類「エアソフトガン」と補正された。 2 引用商標 原査定において,本願商標が商標法第4条第1項第11号に該当するものとして,本願の拒絶の理由に引用した登録商標は,以下のとおりであり,いずれも現に有効に存続しているものである(以下の引用商標1及び引用商標2をあわせて「引用商標」ということがある。)。 (1)国際登録第1261039号商標(以下「引用商標1」という。)は,「IBM Z SYSTEMS」の文字を表してなり,2014年(平成26年)10月24日にフランスにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し,2015年(平成27年)3月16日に国際商標登録出願,「video game software」を含む第9類,第16類,第37類及び第42類に属する国際登録に基づく商標権に係る商標登録原簿に記載された商品及び役務を指定商品及び指定役務(別掲)として,平成29年5月26日に設定登録されたものである。 (2)国際登録第1261046号商標(以下「引用商標2」という。)は,「Z SYSTEMS」の文字を表してなり,2014年(平成26年)10月24日にフランスにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し,2015年(平成27年)3月16日に国際商標登録出願,「video game software」を含む第9類,第16類,第37類及び第42類に属する国際登録に基づく商標権に係る商標登録原簿に記載された商品及び役務を指定商品及び指定役務(別掲)として,平成29年5月26日に設定登録されたものである。 3 当審の判断 (1)本願商標の指定商品について 本願商標の指定商品である第28類「エアソフトガン」は,本物の銃器の形を模した,プラスチックなどでできた弾を発射できる遊戯銃の一種であるところ,当審による職権調査によれば,エアソフトガンには,発射パワーに応じて,法律で所持が禁止されているものや,18歳未満に使わせてはいけないものもあるなど(参照:https://www.tokyo-marui.co.jp/guide/whats/),その使用にあたっては安全性への配慮が求められており,その流通にも年齢等に基づく一定の制限がある実情がうかがえる。そして,エアソフトガンには,その出力に応じて「10才以上用」と「18才以上用」があるところ,市場を構成している大半は「18才以上用」との記事情報もあることから(https://xbusiness.jp/military/marketing),その需要者は子供ではなく,主にサバイバルゲーム愛好家やミリタリー関連商品コレクターなどの成人が中心であるということができる。 以上のとおり,本願商標の指定商品は,主に玩具製造業者により製造され,主に玩具小売業者又は模型玩具小売業者により販売されるエアソフトガンであって,サバイバルゲーム愛好家などの成人を需要者とし,それを用いた遊戯の用途で販売されるものである。 (2)引用商標の指定商品について 引用商標の指定商品中,第9類に属する「video game software」(参考訳:ビデオゲーム機用ゲームソフトウェア)は,家庭用・業務用テレビゲーム機専用のビデオゲーム用ソフトウェアであるところ,これらは主に情報サービス業に属するゲームソフトウェア業者により制作され,主に玩具小売業者・玩具卸売業者又はゲーム用ソフト小売業者若しくは卸売業者により販売される商品であって,家庭用テレビゲーム機に接する幅広い年齢層の消費者や業務用テレビゲーム機を扱うゲームセンターなどの娯楽施設を需要者とし,それらを用いた遊戯の用途で販売されるものである。 (3)本願商標と引用商標の指定商品の類否 本願商標の指定商品である「エアソフトガン」と引用商標の指定商品中第9類に属する「video game software」について,請求人は,両商品は非類似である旨主張しているから,以下,これらの指定商品の類否について詳細に検討する。 本願商標の指定商品と引用商標の指定商品中の「video game software」を比較すると,それぞれの生産部門の業種は相違し(製造業と情報サービス業),それぞれの販売部門は玩具小売業を含む点で共通するものの,それを細分化した業種としては差異があるもので(模型玩具小売業とゲーム用ソフトウェア小売・卸売業など),エアソフトガンの流通には,一般の玩具とは異なり,年齢制限等もあることも踏まえると,それぞれ異なる流通経路を経て販売されることも多いものといえる。そして,両商品は需要者層も相違しており(成人と幅広い年齢層又はゲームセンター),それぞれの用途は遊戯であるとしても,遊戯の内容(サバイバルゲームとビデオゲーム)において差異があることは明らかである。 そうすると,本願商標の指定商品である「エアソフトガン」と引用商標の指定商品中の「video game software」とは,生産部門,販売部門,商品の性質,用途,需要者の範囲を踏まえて総合的に考慮したとしても,それらの商品に同一又は類似の商標を使用するときでも,同一営業主の製造又は販売に係る商品と誤認されるおそれがあるものではなく,互いに類似する商品とはいえない。 また,本願商標の指定商品と,引用商標の上記商品以外の指定商品も,同一又は類似する商品ではない。 (4)まとめ 本願商標は,引用商標とは,その指定商品及び指定役務において,同一又は類似の商品について使用をするものではないため,本願商標と引用商標を比較するまでもなく,商標法第4条第1項第11号に該当しない。 その他,本願商標について拒絶の理由を発見しない。 よって,結論のとおり審決する。 |
