| 理由 |
1 本願商標 本願商標は、「TWIST」の欧文字を横書きで表してなり、第35類に属する願書に記載のとおりの役務を指定役務として、平成26年3月31日に登録出願され、その後、指定役務については、原審における、同27年7月15日付けの手続補正書により、第35類「かばん類及び袋物の小売又は卸売の業務において行われる顧客に対する便益の提供,財布の小売又は卸売の業務において行われる顧客に対する便益の提供,履物の小売又は卸売の業務において行われる顧客に対する便益の提供,ネクタイ・ベルト・スカーフ・その他の被服の小売又は卸売の業務において行われる顧客に対する便益の提供,指輪・イヤリング・ネックレス・ブレスレット・その他の身飾品の小売又は卸売の業務において行われる顧客に対する便益の提供」と補正されたものである。 2 引用商標 原査定において、本願商標が商標法第4条第1項第11号に該当するとして、その拒絶の理由に引用した国際登録第980019号商標(以下「引用商標」という。)は、別掲1のとおりの構成からなり、2008年4月28日にTｕｒkeｙにおいてした商標登録出願に基づいてパリ条約第4条による優先権を主張し、2008年(平成20年)6月18日に国際商標登録出願、別掲2のとおりの商品及び役務を指定商品及び指定役務として、平成23年6月24日に設定登録され、現に有効に存続しているものである。 3 当審の判断 (1)本願商標について 本願商標は、前記1のとおり、「TWIST」の欧文字を横書きしてなるところ、該文字は、「ひねること。ねじること。」を意味する我が国において親しまれた語であることから、該文字に相応して「ツイスト」の称呼を生じ、「ひねること、ねじること」の観念を生じるものである。 (2)引用商標について 引用商標は、別掲1のとおり、図形とその下部に「TWIST」の欧文字を横書きしてなるところ、図形部分と文字部分とは、視覚上、明確に分離されているものであり、また、これらを常に一体不可分のものとしてのみ認識しなければならない格別の事情があるとはいえず、それぞれ独立して、自他商品役務の識別標識としての機能を果たし得るものである。 そして、「TWIST」の文字部分は、「ひねること。ねじること。」を意味する我が国において親しまれた語であることから、引用商標は、該文字部分に相応して「ツイスト」の称呼を生じ、「ひねること、ねじること」の観念を生じるものである。 (3)本願商標と引用商標の類否について 本願商標と引用商標の類否について検討すると、両者の外観は、全体の構成において相違するものの、「TWIST」の文字構成を共通にするから、外観上近似した印象を与えるものであり、両者の称呼及び観念においては、「ツイスト」の称呼と「ひねること、ねじること」の観念を共通にするものであるから、外観、称呼及び観念を総合的に判断すれば、両商標は、互いに紛れるおそれがある類似の商標というべきである。 そして、本願商標の指定役務は、引用商標の指定商品及び指定役務と同一又は類似の役務である。 したがって、本願商標は、商標法第4条第1項第11号に該当する。 (4)請求人の主張について 請求人は、平成27年12月28日付けの上申書及び同28年1月21日付けの手続補正書により、引用商標の商標権者と商標権について譲渡交渉中である旨主張し、審理の猶予を申し出ているところ、相当の期間が経過するも、手続の進展が見られないため、審判長は期間を指定して交渉の進捗状況等を詳述するよう審尋をおこなったところ、何ら応答がないものであるから、これ以上、本件の審理を遅延させるべき合理的な理由はないものと判断し、審理を終結することとした。 (5)まとめ 以上のとおり、本願商標は、商標法第4条第1項第11号に該当し、登録することができない。 よって、結論のとおり審決する。 |
