| 理由 |
1 本件商標 本件登録第5211176号商標(以下「本件商標」という。)は、「CALI SURF」の欧文字を標準文字で表してなり、平成20年6月27日に登録出願され、第18類「皮革製包装用容器,愛玩動物用被服類,かばん類,袋物,携帯用化粧道具入れ,傘,ステッキ,つえ,つえ金具,つえの柄,皮革」及び第25類「被服,ガーター,靴下止め,ズボンつり,バンド,ベルト,履物,仮装用衣服,運動用特殊衣服,運動用特殊靴」を指定商品として、同21年1月26日に登録査定、同年3月6日に設定登録されたものである。 2 請求人の主張 請求人は、本件商標の登録は無効とする、審判費用は被請求人の負担とする、との審決を求め、その理由を要旨次のように述べ、証拠方法として、甲第1号証ないし甲第3号証(枝番号を含む。)を提出した。 (1)無効事由 本件商標は、商標法第4条第1項第11号に該当し、商標法第46条第1項第1号により、その商標登録は無効とされるべきものである。 (2)引用商標 請求人が引用する国際登録第988590号商標(以下「引用商標」という。)は、「CALI SURF CO」の欧文字を横書きしてなり、第9類、第14類、第18類及び第25類に属する別掲のとおりの商品を指定商品として、英国における2008年5月13日の商標登録出願に基づきパリ条約による優先権を主張して2008年(平成20年)11月5日に国際登録されたものであるが、2011年(平成23年)8月26日付けの拒絶査定が、平成24年1月19日に確定している。 3 当審の判断 引用商標は、前記のとおり、2011年(平成23年)8月26日付けの拒絶査定が、2012年(平成24年)1月19日に確定しているものである。 したがって、本件商標を商標法第4条第1項第11号に該当するものとすることはできない。 以上のとおり、本件商標の登録は、商標法第4条第1項第11号に違反してされたものではないから、同法第46条第1項の規定により、無効とすることはできない。 よって、結論のとおり審決する。 |
