1 本願商標 本願商標は、「KOHERAS SｕｐeｒK」の文字を書してなり、第9類「Oｐｔical,meaｓｕｒing,ｓignalling and checking(ｓｕｐeｒｖiｓiｏn)aｐｐaｒaｔｕｓ and inｓｔｒｕmenｔｓ in ｔhe fｏｒm ｏf ｏｐｔical lighｔ ｓｏｕｒceｓ baｓed ｏn nｏnlineaｒ ｏｐｔical media,ｏｐｔical ｔelecｏmmｕnicaｔiｏnｓ haｒdｗaｒe,namelｙ ｏｐｔical filｔeｒｓ fｏｒ ｗaｖelengｔh diｖiｓiｏn mｕlｔiｐleｘing,ｏｐｔical ｓｗiｔcheｓ,fibｒeｏｐｔic cｏmｐｏnenｔｓ,namelｙ fibｒe Bｒagg gｒaｔingｓ fｏｒ ｏｐｔical ｐｒｏceｓｓing,fibｒe laｓeｒｓ ｔhaｔ acｔ aｓ ｏｐｔical ｓｏｕｒceｓ in ｏｐｔical ｔelecｏmmｕnicaｔiｏn ｓｙｓｔemｓ;ｏｐｔical meaｓｕｒing,ｓignalling and checking(ｓｕｐeｒｖiｓiｏn)aｐｐaｒaｔｕｓ and inｓｔｒｕmenｔｓ,namelｙ ｏｐｔical lighｔ gｕideｓ,namelｙ ｗaｖegｕideｓ in ｔhe ｏｐｔical dｏmain,ｏｐｔical fibｒeｓ,ｏｐｔical fibｒe laｓeｒｓ,ｏｐｔical fibｒe gｒaｔingｓ in ｔhe fｏｒm ｏf a cｏmｐｏnenｔ baｓed ｏn a ｐeｒiｏdic ｖaｒiaｔiｏn ｏf ｔhe ｒefｒacｔiｖe indeｘ in ｏｐｔical lighｔ gｕideｓ and ｕｓed in ｏｐｔical ｔelecｏmmｕnicaｔiｏnｓ fｏｒ eｑｕaliｓaｔiｏn ｏf ｏｐｔical amｐlifieｒｓ and ｕｓed in ｏｐｔical ｓenｓing aｓ a ｓenｓｏｒ elemenｔ,ｏｐｔical fibｒe ｓenｓｏｒｓ ｕｓed aｓ ｔheｒmｏmeｔeｒｓ and/ｏｒ ｓｔｒain ｓenｓｏｒｓ fｏｒ ｗaｖelengｔh ｒeｓｐｏnｓe ｔｏ changeｓ in ｔemｐeｒaｔｕｒe and ｓｔｒain;ｏｐｔical fibｒeｓ and ｏｐｔical fibｒe cｏmｐｏnenｔｓ ｕｓed in ｔelecｏmmｕnicaｔiｏnｓ and ｏｐｔical ｓenｓing,namelｙ fibｒe Bｒagg gｒaｔingｓ,fibｒe-baｓed WDM neｔｗｏｒkｓ,fibｒe-cｏｕｐled ｏｐｔical iｓｏlaｔｏｒｓ,fibｒe aｔｔenｕaｔｏｒｓ.」を指定商品として、2005年(平成17年)11月22日に欧州共同体においてした商標出願に基づいてパリ条約第4条による優先権を主張し、2006年(平成18年)4月27日を国際登録の日とするものである。 そして、指定商品及び商品区分については、2008年(平成20年)4月16日付けで国際登録簿に記録された限定の通報があった結果、第9類「Oｐｔical and meaｓｕｒing aｐｐaｒaｔｕｓ and inｓｔｒｕmenｔｓ in ｔhe fｏｒm ｏf ｏｐｔical lighｔ ｓｏｕｒceｓ baｓed ｏn nｏnlineaｒ ｏｐｔical media;ｏｐｔical ｔelecｏmmｕnicaｔiｏnｓ haｒdｗaｒe,namelｙ ｏｐｔical filｔeｒｓ fｏｒ ｗaｖelengｔh diｖiｓiｏn mｕlｔiｐleｘing,ｏｐｔical ｓｗiｔcheｓ,diffｒacｔiｏn aｐｐaｒaｔｕｓ(micｒｏｓcｏｐｙ),namelｙ fibｒe Bｒagg gｒaｔingｓ fｏｒ ｏｐｔical ｐｒｏceｓｓing,fibｒe laｓeｒｓ ｔhaｔ acｔ aｓ ｏｐｔical ｓｏｕｒceｓ in ｏｐｔical ｔelecｏmmｕnicaｔiｏn ｓｙｓｔemｓ;ｏｐｔical and meaｓｕｒing aｐｐaｒaｔｕｓ and inｓｔｒｕmenｔｓ,namelｙ ｏｐｔical lighｔ gｕideｓ and ｗaｖegｕideｓ fｏｒ high ｐｏｗeｒ beam deliｖeｒｙ;ｏｐｔical fibｒeｓ,ｏｐｔical fibｒe laｓeｒｓ,diffｒacｔiｏn aｐｐaｒaｔｕｓ(micｒｏｓcｏｐｙ),namelｙ ｏｐｔical fibｒe gｒaｔingｓ in ｔhe fｏｒm ｏf a cｏmｐｏnenｔ baｓed ｏn a ｐeｒiｏdic ｖaｒiaｔiｏn ｏf ｔhe ｒefｒacｔiｖe indeｘ in ｏｐｔical lighｔ gｕideｓ and ｕｓed in ｏｐｔical ｔelecｏmmｕnicaｔiｏnｓ fｏｒ eｑｕaliｚaｔiｏn ｏf ｏｐｔical amｐlifieｒｓ and ｕｓed in ｏｐｔical ｓenｓing aｓ a ｓenｓｏｒ elemenｔ;ｔheｒmｏmeｔeｒｓ and ｐｒeｓｓｕｒe ｓenｓｏｒｓ,namelｙ ｏｐｔical fibｒe ｓenｓｏｒｓ ｕｓed aｓ ｗaｖelengｔh ｒeｓｐｏnｓe ｔｏ changeｓ in ｔemｐeｒaｔｕｒe and ｓｔｒain;ｏｐｔical fibｒeｓ cableｓ and ｏｐｔical fibｒe cｏmｐｏnenｔｓ ｕｓed in ｔelecｏmmｕnicaｔiｏnｓ and ｏｐｔical ｓenｓing,namelｙ fibｒe Bｒagg gｒaｔingｓ,fibｒe-baｓed ｗaｖelengｔh diｖiｓiｏn mｕlｔiｐleｘing neｔｗｏｒkｓ ｓｙｓｔemｓ;fibｒe-cｏｕｐled ｏｐｔical iｓｏlaｔｏｒｓ,fibｒe aｔｔenｕaｔｏｒｓ.」を指定商品とするものである。 2 原査定の拒絶の理由の要点 原査定は、「指定商品は、商標とともに権利範囲を定めるものであるから、その内容及び範囲は明確でなければならないところ、本願に係る指定商品中『Oｐｔical,meaｓｕｒing,ｓignalling and checking(ｓｕｐeｒｖiｓiｏn)aｐｐaｒaｔｕｓ and inｓｔｒｕmenｔｓ in ｔhe fｏｒm ｏf ｏｐｔical lighｔ ｓｏｕｒceｓ baｓed ｏn nｏnlineaｒ ｏｐｔical media,fibｒeｏｐｔic cｏmｐｏnenｔｓ,namelｙ fibｒe Bｒagg gｒaｔingｓ fｏｒ ｏｐｔical ｐｒｏceｓｓing,ｏｐｔical meaｓｕｒing,ｓignalling and checking(ｓｕｐeｒｖiｓiｏn)aｐｐaｒaｔｕｓ and inｓｔｒｕmenｔｓ,namelｙ ｏｐｔical lighｔ gｕideｓ,namelｙ ｗaｖegｕideｓ in ｔhe ｏｐｔical dｏmain,ｏｐｔical fibｒe gｒaｔingｓ in ｔhe fｏｒm ｏf a cｏmｐｏnenｔ baｓed ｏn a ｐeｒiｏdic ｖaｒiaｔiｏn ｏf ｔhe ｒefｒacｔiｖe indeｘ in ｏｐｔical lighｔ gｕideｓ and ｕｓed in ｏｐｔical ｔelecｏmmｕnicaｔiｏnｓ fｏｒ eｑｕaliｓaｔiｏn ｏf ｏｐｔical amｐlifieｒｓ and ｕｓed in ｏｐｔical ｓenｓing aｓ a ｓenｓｏｒ elemenｔ,ｏｐｔical fibｒe ｓenｓｏｒｓ ｕｓed aｓ ｔheｒmｏmeｔeｒｓ and/ｏｒ ｓｔｒain ｓenｓｏｒｓ fｏｒ ｗaｖelengｔh ｒeｓｐｏnｓe ｔｏ changeｓ in ｔemｐeｒaｔｕｒe and ｓｔｒain;ｏｐｔical fibｒeｓ and ｏｐｔical fibｒe cｏmｐｏnenｔｓ ｕｓed in ｔelecｏmmｕnicaｔiｏnｓ and ｏｐｔical ｓenｓing,namelｙ fibｒe Bｒagg gｒaｔingｓ,fibｒe-baｓed WDM neｔｗｏｒkｓ.』の表示は、その内容及び範囲を明確に指定したものとは認められない。したがって、本願は、商標法第6条第1項の要件を具備しない。」旨認定、判断し、本願を拒絶したものである。 3 当審の判断 本願商標は、前記1のとおりその指定商品が限定された結果、商品の内容及び範囲が明確になったものと認められる。よって、本願の指定商品は、商標法第6条第1項の規定の要件を具備するものとなった。 したがって、本願が商標法第6条第1項に該当するとして、本願を拒絶した原査定の拒絶の理由は解消した。 その他、政令で定める期間内に本願について拒絶の理由を発見しない。 よって、結論のとおり審決する。 |
